Your use of Yast’s services and web sites (referred to collectively as the “Service” in this document) is subject to the terms of a legal agreement between you and Yast. “Yast” means Rocketfarm AS, whose principal place of business is at Trolladalen 30, 6856 Sogndal, Norway .
By using the Service, you have agreed to the terms and conditions set out in this document. These are referred to below as the “Terms of Service”. Yast will treat your use of the Service as acceptance of the Terms of Service from that point onwards.
Yast may make changes to the Terms of Service from time to time. When these changes are made, Yast will make a new copy of the Terms of Service available at http://yast.com/terms and post a message on the blog under the category “terms of service update”. Terms of Service will be made available to you from within the Service.
You understand and agree that if you use the Service after the date on which the Terms of Service have changed, Yast will treat your use as acceptance of the updated Terms of Service.
Use of the Service:
Using the Service is at your sole risk.
To create a user account it is required that you provide Yast with a username and a password. Only you can use the Service with your username and password. You are responsible for keeping your combination of username and password secure and confidential. This information shall not be shared with others. Yast have the right to close down your account without prior notice if Yast suspects there are several users using your user account.
If you become aware of any unauthorized use of your password or of your account, you agree to notify Yast by sending an e-mail to yast@yast.com.
Accounts registered by automated methods are not permitted.
You acknowledge and agree that Yast owns all legal right, title and interest in and to the
Service, including any intellectual property rights which subsist in the Service (whether
registered or not).
You are not allowed to, or attempt to, either modify or adapt the Service or modify another website so as to falsely imply that it is associated with the Service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Yast.
Some parts of the service are only available to paying customers. These services are only available to you if you are 16 years old or older.
As we will do our best to see that it does not occour, you understand that by using the Services you may be exposed to content that you may find offensive, indecent or objectionable. Yast is not obliged to remove this content, but have the right to do so. While Yast prohibits such conduct and content on the Service, you understand and agree that Yast cannot be responsible for the content posted on the Service and you nonetheless may be exposed to such materials.
Violation of any of the terms in this document will result in the termination of your account.
Yast rights:
The Service is constantly under development and as a result it may be necessary to temporary make the Service unavailable. Yast has the right to close down the Service at any time without prior notice. Yast has no obligation to provide you with any information if the Service is shut down or temporary unavailable. Yast will make its best effort to inform about planned unavailability to the Service, but is not obligated to do so.
Technical support is provided via Yast support and feedback forum.
Yast have the right to change prices and information on the Service. Yast will inform you about changes in pricing concerning your payments to Yast. Such information will be provided to you no later than 30 days before the actual price change.
You fully understand that any information from Yast to you will be sent by e-mail only. If you do not provide Yast with a valid e-mail that reaches you, then Yast is not able to inform you about any changes to the Service, including changes in pricing. Providing Yast with your e-mail is done by either having a username identical to your e-mail or by typing it in your account settings.
Yast has the right to store account details as long as you have a registred user account. Yast has the right to store account details for as long as Norwegian laws permits after you terminate your user account. Yast has no responsibility for any loss of data you may experience in your user account.
Yast, in its sole discretion, has the right to suspend or terminate any account and refuse any and all current or future use of the Service, or any other Yast service, if Yast suspects any violation of these terms. Such termination of the Service will result in the deactivation of your account and content or your access to your account and content. In such event, Yast will reimburse your prepaid subscription to the Service.
Yast is not liable to you for:
– Any indirect or consequential losses which may be incurred by you. This shall include any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, or any loss of data suffered by you.
– Any loss or damage which may be incurred by you as as a result of your failure to provide Yast with accurate account information or your failure to keep password or account details secure and confidential.
– Any loss or damage which may be incurred by you as as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Service.
– Any loss or damage which may be incurred by you as as a result of changes which Yast may make to the Service, or for any permanent or temporary cessation in the provision of the Service (or any features within the Service);
The limitations of Yast’s liability to you above shall apply whether or not Yast has been advised of or should have been aware of the possibility of any such losses arising.
Exclusion of warranties:
The Service is provided ”as is”.
Yast does not warrant that the Service will meet your requirements, that defects in the Service will be corrected or that any requests you might have to the Service will be implemented. Further, Yast does not warrant that the Service will be available at any given time. Yast does not warrant that your use of the Service will be uninterrupted, secure, timely or free from error or compatible with any third party products.
General legal terms:
You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
The Terms of Service, and your relationship with Yast under the Terms of Service, shall be governed by Norwegian law. You and Yast agree to submit to the exclusive jurisdiction of the courts of Norway to resolve any legal matter arising from the Terms of Service.
You agree that Yast may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Services
If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Service is invalid, then that provision will be removed from the Terms of Service without affecting the rest of the Terms of Service. The remaining provisions of the Terms of Service will continue to be valid and enforceable.
Nothing in these Terms of Service shall exclude or limit Yast’s liability for losses which may not be lawfully excluded or limited by applicable law.
